Registration and “U.S. Agent” appointments for foreign food, drug, cosmetic, and medical device companies.

If your company is located in the United States and you were appointed as “U.S. Agent” in the past on behalf of a supplier or affiliate, you are subject to new liabilities under the Food Safety Modernization Act (FSMA). If you continue as U.S. Agent, you will be liable to the FDA for the expenses resulting from any re-inspection of a foreign facility or a food product detained at a U.S. port, or from a foreign food facility’s failure to comply with a recall order. This liability could be substantial, and one over which you have little or no control.
